American Casting
& Manufacturing's
Warranty Information...
American Casting & Manufacturing Corp. warrants to the Buyer that
its products are free from defects in workmanship and materials
under normal use and service. In the event of a breach of the
foregoing warranty, American Casting & Manufacturing Corp.’ s sole
obligation is limited to either, at American Casting &
Manufacturing’s option, repairing or replacing any of the products,
provided that the Buyer has notified American Casting &
Manufacturing Corp. as to the nature and extent of, and Buyer has
been authorized to return products. The foregoing warranty is the
sole, only and exclusive warranty available to the Buyer, their
agents or user. The foregoing warranty does not extend to any
persons obtaining the product from the Buyer.
American Casting & Manufacturing Corp.’s warranty, described and
detailed above, is in lieu of any other warranty, expressed or
implied, including but not limited to any implied warranty of
merchantability or fitness for a particular use, and of any other
obligations or liability on American Casting & Manufacturing Corp.’s
part. American Casting & Manufacturing Corp. shall not be, under any
circumstances, liable for any loss, damage or expense or
consequential damage of any kind in connection with the use of, or
inability to use, American Casting & Manufacturing Corp.’s products,
including but not limited to loss of revenue, damage to equipment,
down time or associated costs or claims for such damages, regardless
of whether such damages arise out of breach of contract, warranty or
tort (including negligence). |
